TERMS AND CONDITIONS


Definitions

1.1  “Buyer”

“Buyer” means any individual or legal entity that accesses the Platform for the purpose of browsing, inquiring about, or purchasing goods or services offered by Vendors. Buyers may create accounts, interact with Vendors, and submit ratings or reviews based on completed transactions.


1.2  “Vendor”

“Vendor” refers to any individual, company, or legal entity that registers an account on the Platform for the purpose of listing, marketing, and selling goods or services to Buyers. Vendors are solely responsible for the accuracy of listings, fulfilment of orders, compliance with applicable laws, and customer interactions related to their offerings.


1.3  “User”

“User” is a collective term that refers to any person or entity that accesses or uses the Platform in any capacity, whether as a Buyer, Vendor, or both. All Users are subject to these Terms and Conditions and are responsible for ensuring that their actions do not violate any laws or the rights of others.


 1.4  “Content”

“Content” includes, without limitation, all data, images, text, product descriptions, trademarks, trade names, graphics, logos, audio or video materials,

files, and other materials uploaded, posted, transmitted, or otherwise made available by Users or by the Platform. Content also includes feedback, reviews, and communications initiated through the Platform.


1.5  “Platform”

“Platform” refers to the online marketplace branded as “BugetCartStore,” including all software, databases, user interfaces, applications, domains, and functionalities, whether accessed via desktop, mobile, or any other digital format.


1.6  “Listing”

“Listing” means a public offer created by a Vendor on the Platform which includes product or service details, pricing, delivery information, and any terms specific to that offer. Listings must be accurate, lawful, and updated as necessary by the Vendor.


1.7  “Account”

“Account” refers to a registered user profile created and maintained by a Buyer or Vendor, which provides access to Platform features including order placement, communication tools, and dashboard analytics. Each Account is non-transferable and must be secured with appropriate credentials.


2.  General User Obligations

2.1   Accuracy of Information

Users agree to provide true, complete, and current information during the registration process and to update such information promptly in the event of any changes. BugetCartStore reserves the right to suspend or terminate any account containing false, misleading, outdated, or incomplete information, or if impersonation or misrepresentation is suspected.


2.2   Account Security

Users are solely responsible for maintaining the confidentiality of their login credentials and for all activities that occur under their account. Sharing account access or credentials with third parties is strictly prohibited. BugetCartStore shall not be liable for any unauthorized access or actions taken using a compromised account unless such access results directly from a proven security failure of the Platform.


2.3   Lawful Use

Users may not use the Platform to engage in any conduct that is illegal, unethical, or otherwise prohibited under applicable laws. This includes, but is not limited to, money laundering, fraudulent transactions, trafficking of counterfeit goods, harassment of other users, or violation of intellectual property rights.


 2.4   Compliance with Laws

Users agree to use the Platform only in accordance with all applicable local, state, national, and international laws, rules, and regulations. This includes, without limitation, compliance with customs, tax, export control, consumer protection, and product safety laws.


2.5   Platform Integrity

Users may not attempt to interfere with or disrupt the Platform’s operation, introduce viruses, overload servers, scrape content, or use automated tools that impact the Platform’s functionality. Reverse engineering or attempting to gain unauthorized access to Platform code or data is strictly prohibited.


2.6   Communication Standards

Users must communicate respectfully and professionally with other Users, including through reviews, questions, or messages. Hate speech, threats, spam, and harassment will result in immediate suspension or termination of the offending account.


2.7   Cooperation with Investigations

Users agree to cooperate with any investigation conducted by BugetCartStore or any regulatory or law enforcement authority regarding suspected violations of these Terms, including by providing accurate records, documents, or information upon request.


3.  Buyer Terms

3.1   Relationship Between Buyer and Vendor


Buyers acknowledge and agree that the Platform functions solely as a marketplace facilitator and does not sell, distribute, or take ownership of any products or services listed by Vendors. All purchases made through the Platform constitute a direct contractual relationship between the Buyer and their respective Vendor. BugetCartStore is not a party to any transaction between the Buyer and Vendor.


3.2   Disclaimer of Platform Responsibility

Buyers agree that BugetCartStore does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or sold by a Vendor on the Platform. The Platform does not verify Vendor inventory, shipping practices, product compliance, or representations made in listings. BugetCartStore shall not be liable for any loss, damage, injury, or claim resulting from the use or misuse of a product purchased through the Platform.


3.3   Buyer Due Diligence

It is the sole responsibility of the Buyer to conduct due diligence before placing an order. This includes reviewing Vendor profiles, customer reviews, product descriptions, pricing, shipping details, and any disclaimers or applicable Vendor policies. The Buyer assumes all risk related to the selection and purchase of any goods or services through the Platform.


3.4   Buyer Conduct

Buyers shall not use the Platform to harass, abuse, defame, or otherwise harm Vendors or other users. Buyers are expected to communicate courteously, report issues in good faith, and refrain from retaliatory reviews or false claims. Abuse of the review system or buyer protections may result in suspension or termination of account privileges.


3.5   Taxes and Customs

Buyers are solely responsible for the payment of any applicable sales tax, VAT, customs duties, or other governmental charges arising from purchases made through the Platform, depending on jurisdiction.


3.6   Disputes with Vendors

In the event of a dispute related to a product or transaction, Buyers are encouraged to contact the Vendor directly through the Platform’s communication tools. While BugetCartStore may, at its sole discretion, provide limited support or mediation, the Platform is not liable for resolving disputes and has no authority to enforce refunds, replacements, or returns.


4.  Vendor Terms

4.1   Order Fulfillment and Delivery Responsibility

Vendors are independently and fully responsible for processing, packaging, shipping, and delivering all goods sold through the Platform. BugetCartStore does not facilitate logistics, warehousing, or shipment tracking. Vendors must fulfill orders in a timely and professional manner, consistent with the shipping details and delivery timeframes listed in their product descriptions. Failure to fulfill or delay shipments may result in account warnings, order cancellation, or suspension from the Platform.


4.2   Prohibited Listings and Product Misrepresentation

Vendors agree not to post or sell any items that are unlawful, restricted, hazardous, counterfeit, or otherwise prohibited under Section 6 (Prohibited Items and Activities) of these Terms. All listings must be accurate and must not mislead buyers regarding the nature, origin, functionality, quantity, or condition of goods. The use of deceptive images, inflated pricing tactics, or falsified product certifications is strictly prohibited and grounds for immediate removal from the Platform.


4.3   Legal Authority and Intellectual Property Assurance

By listing an item on the Platform, Vendors warrant and represent that they are the legal owner or authorized reseller of such item and have full rights to offer it for sale. Vendors further represent that the product, description, and any associated media (e.g., images, logos, product manuals) do not infringe upon any patent, trademark, copyright, or other intellectual property rights of any third party. Vendors shall indemnify and hold harmless BugetCartStore against any claim, dispute, or legal action arising from a breach of this provision.


4.4   Tax Compliance and Reporting Obligations

Vendors are solely responsible for determining, collecting, reporting, and remitting any applicable sales tax, VAT, use tax, or other transactional taxes imposed by governmental authorities based on the Vendor’s jurisdiction, the Buyer’s jurisdiction, or the place of delivery. BugetCartStore does not assume liability for any vendor’s tax obligations and does not provide tax or legal advice.



4.5   Vendor Conduct and Communications

Vendors must maintain professional conduct in all communications with Buyers and BugetCartStore representatives. Harassment, retaliation, abusive language, or discriminatory remarks may result in disciplinary action, including but not limited to account restrictions, listing removal, or permanent suspension.


4.6   Product Recalls and Compliance

Vendors are required to comply with any applicable product recall laws and must immediately remove recalled items from the Platform. If a product sold is later found to be in violation of safety, labeling, or regulatory compliance standards, the Vendor must notify affected Buyers and offer a remedy consistent with applicable law.


4.7   Record-Keeping and Audit Cooperation

Vendors must maintain records of sales, product sourcing, and fulfillment in accordance with applicable commercial and tax regulations. Vendors agree to provide such documentation upon request by BugetCartStore in the event of a dispute, investigation, or regulatory inquiry.


5.  Intellectual Property

 5.1   Prohibition on Infringing Content and Listings

Vendors are strictly prohibited from uploading, listing, distributing, promoting, or selling any goods, services, or content that infringes upon the intellectual property rights of any third party. This includes, without limitation, unauthorized use of copyrighted material, trademarks, trade names, trade dress,

logos, patents, proprietary formulas or designs, or any confidential business information belonging to others. Vendors must ensure that all materials associated with their listings—such as product images, brand names, and descriptions—are either owned by them or properly licensed for commercial use.

5.2   Enforcement of Intellectual Property Rights

BugetCartStore takes allegations of intellectual property infringement seriously. The Platform reserves the right, at its sole discretion and without prior notice, to remove or disable access to any content that is the subject of a complaint or legal notice. In cases where credible allegations are made—whether via takedown notices, court orders, or internal investigations—BugetCartStore may suspend or permanently terminate Vendor accounts, with or without prior warning. Repeat offenders will be permanently banned from the Platform.


5.3   User-Generated Content License

While Users retain ownership of their content, including product listings, descriptions, images, and brand materials, by submitting such content to the Platform, Users grant BugetCartStore a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, publish, display, modify (for formatting or display purposes only), distribute, and otherwise exploit such content for the purposes of operating, marketing, and improving the Platform and its services. This license remains in effect until the content is removed from the Platform or until the User’s account is terminated, subject to reasonable archival and legal compliance requirements.

5.4   Claims and Takedown Procedure

If any party believes that content hosted on the Platform infringes upon their intellectual property rights, they may file a written complaint to BugetCartStore, including the following details: (i) a detailed description of the alleged infringement, (ii) identification of the protected work(s), (iii) contact information of the rights holder, and (iv) a sworn statement of ownership or authorization to act on behalf of the rights holder. Upon receipt of a properly formatted notice, BugetCartStore will investigate and take appropriate action as required under applicable law.

5.5   No Waiver of Rights

Nothing in these Terms shall be construed to grant any User ownership rights over the BugetCartStore name, logo, trademarks, or proprietary software. All rights not expressly granted in this Agreement are reserved by BugetCartStore.


6.  Prohibited Items and Activities

6.1   Prohibited Listings

Users, including Vendors, are strictly prohibited from offering, selling, distributing, or promoting any goods or services on the Platform that fall under the following non-exhaustive categories:

  • Illegal Products: Any goods whose manufacture, sale, distribution, or possession violates applicable laws or regulations, including but not limited to controlled substances, drug paraphernalia, and unauthorized prescription medications. 
  • Firearms and Ammunition: Including, but not limited to, handguns, rifles, bullets, and firearm components or accessories (e.g., magazines, suppressors, or bump stocks), whether real or replica.
  • Counterfeit or Pirated Goods: Items that bear unauthorized trademarks, logos, or intellectual property of third parties, or that otherwise constitute unauthorized reproductions of branded products.
  • Stolen or Misappropriated Property: Any item obtained through theft, fraud, or unauthorized access or that is not legally owned by the Vendor.
  • Hazardous Materials: Including flammable, toxic, corrosive, or otherwise dangerous chemicals, substances, or devices, unless explicitly permitted by applicable law and appropriately disclosed and labeled.
  • Hate-Based Materials: Content that incites, promotes, or glorifies hatred, violence, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or nationality.
  • Adult Content or Services: Pornographic materials, explicit sexual services, or any listing that violates public decency standards or platform policies.
  • Human Parts and Remains: Including organs, tissues, bones, or body fluids, whether for medical or cultural reasons.
  • Surveillance Equipment: Spy cameras, keyloggers, and other devices intended for unauthorized surveillance or stalking.
  • Multi-Level Marketing (MLM) or Ponzi Schemes: Listings that promote participation in schemes that are deceptive, unsustainable, or unlawful under consumer protection laws.

6.2   Prohibited Activities

Users shall not engage in any activity that compromises the safety, fairness, or legality of the Platform. This includes, but is not limited to:

  • Fraudulent Transactions: Including the use of stolen payment credentials, chargeback abuse, or false claims.
  • Manipulation of Platform Tools: Attempting to manipulate reviews, ratings, search results, or algorithms.
  • Harassment   or   Abuse:   Threats,   intimidation,   spamming,   or   abuse   of communication tools directed at other Users or BugetCartStore staff.
  • Interference with Platform Operations: Hacking, DDoS attacks, scraping, or deploying any code intended to damage or disrupt Platform functionality.
  • Impersonation or Misrepresentation: Creating fake accounts or misrepresenting affiliation with BugetCartStore or another User.


6.3   Enforcement and Remedies

BugetCartStore reserves the right to investigate and take any action it deems appropriate in response to violations of this section, which may include:


  • 1.     Immediate removal of listings
  • 2.     Account warnings or restrictions
  • 3.     Permanent suspension or termination of User accounts
  • 4.     Reporting of unlawful conduct to appropriate law enforcement authorities
  • 5.     Legal action for damages or injunctive relief where applicable
  • 6.     BugetCartStore’s decisions under this Section shall be final and binding.


  7.  Account Termination

 

7.1   Termination by BugetCartStore

BugetCartStore reserves the right, in its sole discretion and without prior notice, to suspend, restrict, or permanently terminate any User account for any reason, including but not limited to:

Violation of these Terms and Conditions;

  • Repeated complaints or substantiated negative feedback from other Users; Engagement in prohibited or illegal activities on the Platform;
  • Attempts to manipulate the Platform’s systems, such as feedback scores or search rankings; Failure to respond to compliance-related requests, including suspected fraud or intellectual property violations.
  • Suspension or termination may include the removal of all listings, forfeiture of any active transactions, and loss of access to account history, settings, and communications.
7.2   Voluntary Termination by User

Users may terminate their account at any time by submitting a written request to the Platform’s support team via the designated contact form or customer service email. Upon receipt of such request, BugetCartStore will process the termination within a commercially reasonable timeframe, subject to the settlement of any pending transactions, disputes, or obligations.

7.3   Effect of Termination

Upon termination—whether initiated by the User or BugetCartStore—any rights granted under this Agreement shall immediately and automatically cease. This includes the right to access the Platform, use any associated features, or retrieve data except as required by law. Terminated accounts may not be reinstated or re-registered without prior written approval from BugetCartStore.


7.4   Data Retention and Deletion

Following account termination, BugetCartStore may retain certain information, including transaction history and account records, for the purpose of legal compliance, fraud prevention, dispute resolution, or enforcement of these Terms. Such data will be handled in accordance with the Platform’s Privacy Policy.


7.5   No Right to Continuation

Users acknowledge and agree that use of the Platform is a privilege, not a right. BugetCartStore is under no obligation to continue offering access to any User and shall not be liable for any loss or damages arising from account suspension or termination.
